LIVING MARINE RESOURCES MANAGEMENT
(MISCELLANEOUS AMENDMENTS) BILL 2006

Mr DEAN ( Windermere ) - I think the honourable member for Nelson has covered a few of the points I wanted to cover but I stand in support of the bill. I think it has been well done and I want to thank the Leader today for the briefing. I thought that the briefing was well done and the briefing covered many of the areas and points that I wanted to raise as well.

I think we are all aware - I certainly am and some members now would be - that a lot of this comes out of Operation Oakum, which was one of the biggest fishing industry operations conducted by the police in this State and it led out of this country to overseas. It was a very significant operation throughout which a lot of difficulties were encountered and this will satisfy a lot of those needs. It is good to see the Government act so quickly to fix a lot of these problems. I want to thank them for that.

The other thing that I raised this morning is that very clearly this has been done right and I have often criticised the Government for not consulting -

Mr DEAN - Well, I have done and I think it is only right to do it the other way as well. In this case the industry have not contacted me and they did previously on amendments that were done 12 months to two years ago and also the recreational fishers contacted us when the netting provisions were changed - there was a lot of controversy about that - but on this occasion there has been no contact at all and they never at any one stage sought a briefing with us, so that is an indication to me that they have been properly consulted throughout this and that they are satisfied with what is going on. I rise to simply mention those things.

The Aboriginal situation has been covered and that was raised with me some time ago, the right of our Aboriginal people to take shells for their necklace-making and all of those things. That is clearly covered now as well. It is a real art and the Aboriginal people do some great things with them so why should they be cut off from following something that they have done for thousands and thousands of years? That is all covered here. I think the amendments are good and I look forward to how they will be utilised in the future.

The indictable offences one I will just touch on. The honourable member for Nelson touched on that but that simply brings that into line with other criminal acts where in certain situations people do have a choice. The person is charged and if both parties agree to it, it can go either go to a summary hearing or to a criminal court so it brings it into line there and I think it makes it much quicker and much easier in a lot of respects because a lot of the cases are borderline as to where they should go and very clearly there are cases that ought not go on indictment because of the time and the costs involved in that area. So I think those are good amendments as well. I will be supporting the bill.
