MAGISTRATES COURT AMENDMENT BILL (No. 2) 2003

Mr DEAN (Windermere) - Mr President, I will just keep my comments very brief and to the point here but I commend once again the people involved in this legislation. It is very welcome and I would suggest it is very welcome to all of those people who find themselves as witnesses to events that occur from time to time either as a victim and/or as having observed an incident or what have you.

We know it is very traumatising to those people to have to wait for their cases to come up before the courts and at the end of the day we know also, and I know as an ex-police officer, that many cases are lost because of the factor of time. Witnesses move on, witnesses lose interest for some reason or another and the other matter that is of concern is that a case that is seen as very serious and significant today may not necessarily be as serious, say, in 12 months' time. I think justice delayed is justice denied to people, a comment of Mr Hodgman from time to time.

It is certainly welcome legislation to see part-time magistrates being appointed. It is certainly a move in the right direction. As the President would know, he is a great advocate of part-time policing in the same way and I think we may well move down that line in due course as well. I certainly see this bill as being a great move forward and in the best interests of law and order at the end of the day.
