TRAFFIC AMENDMENT BILL 2009

Mr DEAN ( Windermere ) - Madam President, I rise to make a very brief comment on that response. I thank the Leader for the Government for coming back so quickly on that point. It was an issue raised because of the fact that police will need, I would think, unfortunately in some situations, a right to force entry into a vehicle for that purpose where they have good reason to believe that there is a device in there that will detect speed-reading devices; speed cameras, et cetera. This is done for their protection. It was always a concern for police, even when I was there, about their rights in some circumstances to enter vehicles in particular situations. So it would seem that there needs to be a little more work done on this and I would appreciate the Government's position in discussing the matter with the police, and for the police to come forward at the end of the day, with an amendment to ensure that they do have the right to enter those vehicles in those circumstances. Where we have a reason to believe that a radar-detection device is in a vehicle, then it needs to be fixed very quickly because those people quite obviously are in the habit of wanting to exceed speed limits. They have the device for the purpose of defending themselves against detection.
